2nd reklamo vs PBBM puna sa polisiya, di impeachment offense
ANG ikalawang impeachment complaint laban kay Pangulong Ferdinand R. Marcos Jr. ay hindi umaabot sa pamantayang hinihingi ng Konstitusyon para sa isang kasong impeachment, dahil ito ay isang policy critique lamang, pahayag ng vice chair ng House committee on justice na si Alfredo A. Garbin Jr. nitong Miyerkules.
“So my take on this, Madam Chair, is that this pleads a policy critique. It does not plead an impeachable offense nor a willful constitutional breach,” sinabi ni Garbin sa House committee on justice, habang sinusuri ng panel ang reklamong inihain nina dating kongresista Liza Maza at iba pa, at inendorso ng Makabayan bloc.
Aniya pa, ang mga alegasyon ng korapsiyon gamit ang umano’y “BBM parametric formula” ng Department of Public Works and Highways (DPWH) sa infrastructure planning ay walang basehan.
“Let me state, Madam Chair, that this is not sufficient in substance,” ani Garbin sa komite na pinamumunuan ni Batangas Rep. Gerville “Jinky Bitrics” Luistro bilang chair, at ibinasura ang mga paratang na ang planning framework mismo ay isang corruption scheme.
Sinabi pa niya na mali ang basehan ng complaint na ang policy prioritization sa pag-budget ng gobyerno ay korap.
“A planning allocation formula is not illegal on its face. Government budgeting necessarily involves policy priorities,” aniya.
Iginiit niya na ang pagbanggit sa “priorities of leaders” ay hindi ebidensiya ng katiwalian.
“The phrase ‘priorities of leaders,’ even if quoted, is not proof of graft,” ani Garbin. Dagdag pa niya, ang mga ganitong konsiderasyon ay “consistent with political accountability in appropriations, especially where Congress itself sets national priorities.”
Wala ring partikular na constitutional provision na nilabag batay sa mga paratang, aniya.
“The complaint does not cite a constitutional provision prohibiting executive consideration of policy priorities in infrastructure programming,” pahayag ni Garbin.
Sinabi pa niya na walang kongkretong akto na iniuugnay sa Pangulo na magpapatunay ng korapsiyon.
“No pleaded fact shows that the President authored, ordered, or used the formula to commit a corrupt act,” saad ni Garbin.
“The complaint infers presidential culpability from branding BBM and from the existence of managed stage. That is not ultimate facts, Madam Chair. It is an argument,” dagdag niya.
Binanggit pa niya ang isang mahalagang “evidentiary gap” sa complaint.
“No annex authentic DPWH document is shown in the filed copy,” ani Garbin. May sources na binanggit, aniya, ngunit ang na-file na kopya ay walang nakalakip na kumpletong DPWH policy issuance bilang certified annex para ito’y maberipika ng komite.
“Without the annexes, the committee is being asked to accept the complainant’s characterization rather than reviewing the underlying document,” ani Garbin.
