“THIS is a victory not just for me and the voters of Manila’s sixth district—but for the Constitution, and the Rule of Law.”

Ito ang pahayag ni Rep. Bienvenido “Benny” Abante Jr. matapos lumabas ang desisyon ng Commission on Elections (Comelec) Second Division na ipawalang-bisa ang proklamasyon ni Luis “Joey” Chua Uy bilang nanalo sa congressional race sa ika-anim na distrito ng Maynila.

Ang pagdiskuwalipika kay Uy ay nangangahulugan na si Abante ang nanalo sa nakaraang halalan.

“The Constitution is clear—only natural-born Filipino citizens are qualified to serve in Congress. The Comelec ruling reaffirms this fundamental requirement and protects the integrity of our democratic institutions,” sabi ni Abante.

Dagdag pa niya, “This case sets an important precedent. It reminds us that those seeking public office must be held to the highest standards of eligibility and truthfulness. Our people deserve leaders whose allegiance to the country is beyond question, and whose qualifications are beyond doubt.”

Sa desisyong inilabas ng Comelec, sinabi nito na si Uy ay nagbigay ng maling impormasyon sa kanyang Certificate of Candidacy (COC) nang ideklara na siya ay isang natural-born Filipino citizen. Napag-alaman ng Comelec na si Uy ay “at most a naturalized citizen” at samakatuwid ay hindi kwalipikadong tumakbo bilang kongresista sa ilalim ng Seksyon 6, Artikulo VI ng 1987 Konstitusyon, na nagsasaad na “No person shall be a Member of the House of Representatives unless he is a natural-born citizen of the Philippines.”

Dahil dito, idineklara ng Comelec: “The proclamation of respondent Luis ‘Joey’ Chua Uy is hereby annulled… and Bienvenido M. Abante Jr., being the only qualified candidate who garnered the highest number of votes, is hereby declared the duly elected member of the House of Representatives for the Sixth District of the City of Manila.”

Iginiit ng Komisyon na ang diskwalipikasyon dahil sa kawalan ng kwalipikasyon ay hindi lang isyu matapos ang halalan, kundi nagsisimula pa lamang sa simula ng kandidatura. Ayon sa kasong Maquiling v. Comelec, kapag hindi kwalipikado ang isang kandidato, wala nang bisa ang kanyang COC mula pa noong una, at ang mga boto para sa kanya ay hindi na binibilang at itinuturing na stray votes.

Sa inihaing petisyon ni Abante, iprinisinta ang ebidensyang si Uy, na ipinanganak noong 1962 sa mga magulang na parehong Chinese citizen, ay naging mamamayang Pilipino lamang matapos ma-naturalize ang kanyang ama noong 1967. Binigyan si Uy ng Identification Certificate ng Bureau of Immigration—hindi dahil sa karapatang makamit ito sa pagsilang, kundi bilang bunga ng naturalization ng kanyang ama.

“A natural-born citizen acquires citizenship by birth, without the need for any act or proceeding. Mr. Uy’s case clearly required legal processes under naturalization laws, disqualifying him from ever being considered natural-born,” ayon sa desisyon.

Iginiit pa ni Abante: “This is not about personalities—this is about the rule of law. The Constitution must prevail. Our democracy depends on it.”
