SINABI ni Senador Francis “Kiko” Pangilinan na hindi ang impeachment court ang tamang venue para pagdebatehan ang challenge ni Senador Alan Peter Cayetano sa amyendadong rules kung sino ang maaaring mamuno sa impeachment trial ni Vice President Sara Duterte.

Inihayag ni Pangilinan ang argumento matapos kuwestiyunin ni Cayetano ang amended impeachment rules ng Senado, sinabing nakapirmi sa Konstitusyon ang presiding role sa impeachment cases sa Senate President, maliban kung ang nililitis ay ang Pangulo ng Pilipinas at ang Chief Justice ang mamumuno.

Iginiit ni Cayetano na hindi maaaring lumihis ang impeachment court sa naturang kaayusan sa pamamagitan ng rule amendment o majority vote. Sinabi niya na ang kapangyarihan ng Senado na duminig ng impeachment cases ay dapat pa ring gamitin alinsunod sa Konstitusyon.

“It is a single exception and otherwise the presiding officer should be the Senate President. It is the exception that proves the rule,” ani Cayetano.

“If the Constitution and its framers prescribe who shall preside, who are we to change the Constitution here today?” dagdag ni Cayetano.

Kinontra ito ni Pangilinan, sinabing walang tahasang nakasaad sa Konstitusyon na kailangang ang Senate President ang mamuno kapag ang nililitis ay ang Vice President o iba pang impeachable official.

“Nowhere in the Constitution, in the provisions on public accountability and impeachment does it say that the Senate President must preside when the Vice President is under trial or any other impeachable officer,” ani Pangilinan.

Sinabi niya na pinahihintulutan ng Konstitusyon ang Congress na gumawa ng sariling rules, idinagdag na inaprubahan ng Senado ang mga amyenda sa impeachment rules noong June 3.

Ayon kay Pangilinan, naratipikahan kalaunan ang June 3 Journal nang magpulong ang Senado sa special session noong June 17.

“The June 3 Journal was ratified unanimously on June 17 when we had our special session,” ani Pangilinan.

Sinabi ni Pangilinan na dahil dito, may presumption of regularity ang amended rules.

Ayon pa kay Pangilinan, dapat talakayin ang usapin ng Senado bilang legislative body o resolbahin ng Supreme Court.

“The good gentleman from Taguig has brought this matter before the Supreme Court,” ani Pangilinan.

Tinukoy ni Pangilinan na walang temporary restraining order na inilabas laban sa proceedings.

“There is no temporary restraining order. There was a request for a status quo ante order. It was not granted. And therefore, the presumption of regularity behooves us as an impeachment court to proceed,” ani Pangilinan.

Iginiit niya na improper ang point of order ni Cayetano dahil nakabinbin na ang usapin sa Supreme Court.

“In fact, the debate on this matter here in the impeachment court is out of order,” ani Pangilinan.

Dahil sa palitan, napabilang ang presiding officer rule sa mga unang procedural dispute sa impeachment trial bago ang presentasyon ng ebidensya.
