INIHAIN ang ikatlong beripikadong reklamong impeachment na naglalayong mapatalsik si Vice President Sara Z. Duterte sa Kamara de Representantes, kung saan binanggit ng mga nagreklamo ang mga paratang kaugnay ng paggamit ng confidential funds at ang salaysay ng dating aide ni Duterte na si Ramil Madriaga.

Ang reklamo, na umabot sa tanggapan ni House Secretary General Cheloy Garafil, ay inihain ng “a group of private citizens composed of members of the clergy, civil society leaders and legal practitioners,” at inendorso ni House Deputy Minority Leader Leila de Lima ng Mamamayang Liberal (ML) Party-list.

Kabilang sa mga nagreklamo sina Rev. Fr. Joel Saballa, Rev. Fr. Joselito S. Sarabia, Rev. Fr. Edilberto J. Baculi, Rev. Fr. Rogelio D. del Rosario, Pastor Leonard P. Arevalo, Pinky L. Tam, Maria Loreto A. Lopez, Atty. Jalilo O. dela Torre, Atty. Democrito C. Barcenas, Atty. Lourdes Barcenas, Sister Ma. Liza Ruedas, Sister Violeta B. Cecilio at Sister Geraldine J. Denoga.

Sa kanilang petisyon, sinabi ng grupo na ang reklamo ay “a verified complaint for impeachment against Vice-President Sarah Zimmerman Duterte pursuant to Section 2, Article XI of the 1987 Constitution,” na nagsasaad na ang Bise Presidente “may be removed from office on impeachment for, and conviction of, culpable violation of the Constitution, treason, bribery, graft and corruption, other high crimes or betrayal of public trust.”

Ayon sa reklamo, nakabatay ito sa mga paratang na kinabibilangan ng “Culpable Violation of the Constitution, Betrayal of Public Trust, Plunder and/or Malversation, Bribery, Graft & Corruption, and other High Crimes,” at inihain ito alinsunod sa Section 3, Article XI ng Konstitusyon, na nagsasaad na ang “House of Representatives shall have the exclusive power to initiate all cases of impeachment.”

Sa ilalim ng mga batayan ng impeachment, inakusahan ang Bise Presidente na lumabag sa Konstitusyon at nagtraydor sa tiwala ng publiko “in amassing and converting the amount of not less than Five Hundred Million Pesos (P500,000,000.00) from the confidential funds allocated to the Office of the Vice-President for the years 2022 and 2023.”

Binanggit din ang “amount of not less than One Hundred Twelve Million Five Hundred Thousand Pesos (P112,500,000.00) from the confidential funds allocated to the Department of Education for the year 2023.”

Isa pang batayan ang umano’y “corrupting and bribing officials of the Department of Education.”

Kabilang pa sa mga paratang ang “contracting to murder or assassinate the President, the First Lady, and the former Speaker of the House,” “amassing unexplained wealth and failing to disclose all her properties and interests in properties in her SALN,” at “committing acts of political destabilization and the high crimes of sedition and insurrection.”

Sa kanilang paliwanag, iginiit ng reklamo na kumilos si Duterte “in conspiracy with Acosta, Col. [Philippine Army Colonel Raymund Dante] Lachica, and Madriaga” sa mga usapin na may kinalaman sa confidential funds, at inakusahan na si Madriaga “delivered the funds to people that have connection with the Vice-President.”

Binanggit din sa reklamo ang testimonya umano mula sa isang pagdinig ng House committee, kabilang ang tanong tungkol sa nag-utos na maghanda ng disbursement voucher: “Ah…pag ni-release na po ang SARO, mag-instruct po sa akin ang head of agency na puwede na po mag-prepare ng disbursement voucher.” Nang tanungin kung sino ang head of agency, ang sagot umano ay: “Ma’am VP Sara po.”

Dagdag pa ng reklamo, “Without VP Sara’s instructions and approval, neither Acosta, Col. Lachica, nor Madriaga could have disposed the P500,000,000.00,” at sinabing “VP Sara’s participation in the disposition of the confidential funds was indispensable.”

Sinabi ng complainants na inihain nila ang kaso sa Kamara alinsunod sa probisyon ng Konstitusyon tungkol sa impeachment at sa mga batayang kanilang inilatag sa verified complaint.
