DOJ: Walang legal na balakid sa paglipat ng PhilHealth sa ilalim ng OP

WALANG nakikitang legal na balakid ang Department of Justice (DOJ) sa plano na ilipat ang Philippine Health Insurance Corporation (PhilHealth) sa ilalim ng Office of the President (OP).

Ayon sa DOJ sa ilalim ng Administrative Code of the Philippines, ang Pangulo ay mayroong “continuing authority” na ireorganisa ang OP.

“We advise that there is no legal issue on the possible transfer of PhilHealth to the OP as it is a legitimate exercise of the President’s power of control over the executive department, bureaus, and offices,” sabi ng DOJ.

“In addition, the President should have the power to shape and/or reshape its office, in the manner he deems fit to carry out his directive and policies, in order to achieve simplicity, economy, and efficiency in government,” dagdag pa ng ahensya.

Nagbigay ng opinyon ang DOJ alinsunod sa kahilingan ni Governance and Organization Development Team Undersecretary Kenneth Ronquillo kaugnay ng inaasahang planong paglipat sa PhilHealth.

Isa sa mga itinanong sa DOJ ay ang epekto ng paglipat sa PhilHealth sa Joint Congressional Oversight Committee na sumisilip sa implementasyon ng Universal Health Care Act (UHC).
