GAGAMITIN umano ng House prosecution panel ang mga aral mula sa impeachment trials nina dating Pangulong Joseph “Erap” Estrada at Chief Justice Renato Corona sa ginagawa nitong paghahanda sa paglilitis ni Vice President Sara Duterte.

Ayon kay San Juan Rep. Ysabel Maria Zamora, miyembro ng House prosecution panel, ang mga nakaraang impeachment trial ay nagbibigay ng mahahalagang kaalaman tungkol sa suporta ng publiko, estratehiyang legal, at mga pamantayan sa ebidensya na makatutulong sa pagpapatibay ng kaso laban sa Ikalawang Pangulo.

“The prosecution has already been reviewing, studying, and preparing for the trial,” pahayag ni Zamora sa isang forum na inorganisa ng University of the Philippines College of Law tungkol sa impeachment trial ni VP Duterte.

“Learning from the Erap impeachment, public support is very important as this is a political exercise. The influence of the public is very important, we should muster the public’s support in this case,” dagdag niya.

Binigyang-diin din ng mambabatas ang pangangailangang maging handa sa pagpapakita ng matibay na ebidensya para sa bawat Article ng Impeachment. “We should be ready… to defend these Articles and have evidence for each so we won’t be berated by… our senator-judges.”

Tungkol sa mga gagamiting prosesol, tinukoy ni Zamora ang mga naunang alituntunin ng Senado kaugnay ng kanilang papel sa impeachment trials.

“There is Section 11, if I am not mistaken, that an adjournment of the Senate sitting as a trial court shall not operate as an adjournment of the Senate as a legislative body,” aniya.

“In my humble opinion, I think the reverse should actually be stated as well, so as to remove all of these issues on whether we can proceed with trial,” dagdag niya.

Tungkol sa pamantayan na kinakailangan para ma-convict ang nasasakdal, binigyang-diin ni Zamora ang pangangailangan para sa matibay na ebidensya na hindi lamang magbibigay-katwiran sa pagpapatalsik sa opisyal kundi magreresulta rin sa kanyang panghabambuhay na diskwalipikasyon sa paghawak ng pampublikong posisyon.

“Going back to the requisite standard that we need to convict… it should be something that will convince a senator or even a layperson to remove the official,” paliwanag niya.

“And it should be convincing enough that it carries the consequence that he or she will be further disqualified from (holding) future office,” dagdag pa niya.

Binalikan din niya ang pananaw ng eksperto sa batas konstitusyunal na si Fr. Joaquin Bernas, na naglarawan sa impeachment bilang isang prosesong pampulitika na malaki ang nakasalalay sa pakiramdam ng mga senador-hukom.

“I remember also the standard mentioned by Bernas in his impeachment primer – since it is a political exercise, the standard is his gut feel, the gut feel of the senators that is required,” ayon kay Zamora.

Nanawagan din si Zamora para sa mas maayos at masusing talakayan ng publiko ukol sa impeachment, aniya, “We should really elevate the level of discourse as regards to impeachment.”

Naging daan ang forum ng UP College of Law upang pag-usapan ng mga eksperto at legal practitioners ang iba’t ibang aspeto ng impeachment.

Iginiit ni Zamora na ang impeachment ay hindi lamang isang laban sa larangan ng batas kundi isang pagsubok sa pananagutan sa demokrasya. Dagdag pa nito mahalaga ang pakikilahok ng publiko at ang tamang kaalaman ng mamamayan sa pagpapatibay ng hustisya at kaayusang konstitusyunal.
