NAGBABALA nitong Sabado si House Committee on Justice chair Gerville “Jinky Bitrics” Luistro ng Batangas na nanganganib na mahatulan si Vice President Sara Z. Duterte kung tatanggi siyang lumahok sa posibleng Senate impeachment trial, na inilarawan niya bilang “huling pagkakataon” ng Bise Presidente upang maglahad ng ebidensya at pabulaanan ang mga kaso laban sa kanya.

“If I were in her shoes, I will appear because this is my last opportunity to present my case,” sabi ni Luistro sa Saturday News Forum sa Dapo Restaurant sa Quezon City.

“If I miss this opportunity, then I should anticipate the possibility of losing this case or in other words receiving a judgment of conviction,” dagdag niya.

Ginawa ni Luistro ang pahayag nang tanungin siya kung inaasahan niyang personal na haharap si Duterte sa Senate impeachment court matapos itong paulit-ulit na hindi dumalo sa mga pagdinig ng House Committee on Justice sa kabila ng ilang paanyaya mula sa panel.

Inaasahang tatalakayin ng House plenary sa Lunes ang committee report at Articles of Impeachment laban kay Duterte matapos magkaisa ang justice panel sa paghanap ng probable cause at kalaunan ay nagkaisang aprubahan ang impeachment report para sa floor deliberations.

Nilalaman ng impeachment report ang mga findings kaugnay ng umano’y maling paggamit ng confidential funds, unexplained wealth, panunuhol, at mga pagbabanta laban kina Pangulong Ferdinand R. Marcos Jr., First Lady Liza Araneta-Marcos, at noo’y Speaker Ferdinand Martin G. Romualdez.

Nang tanungin kung dadalo si Duterte sa paglilitis dahil sa pananaw na marami itong kaalyado sa Senado, sinabi ni Luistro na inaasahan niyang haharap ang Bise Presidente dahil ang impeachment proceedings ang magiging huling pagkakataon nito upang direktang kuwestiyunin ang mga ebidensya ng prosekusyon.

“I wish to believe na dadating ang Bise Presidente because this is her last opportunity to present her evidence,” sabi ni Luistro.

“And if she will be missing this opportunity, then we have reason to believe na baka nga mag-result ito sa conviction,” muli niyang diin.

Binigyang-diin ni Luistro na kahit nakakita na ng probable cause ang House panel, nakadepende pa rin ang magiging resulta ng Senate trial sa magiging tugon ng depensa sa mga ebidensya ng prosekusyon.

“I think she should participate fully this time to be able to present her evidence, counter the evidence of the prosecution, dahil wala pa namang judgment,” aniya. “This trial may result to conviction, but it may also result to acquittal, depending on the evidence which will be presented by the defense.”

Ayon kay Luistro, ang conviction ay nakasalalay sa kung epektibong mapapabulaanan ng kampo ni Duterte ang mga ebidensyang iniharap ng mga complainant sa harap ng mga senator-judges.

“Because we’ve seen already the complainant’s evidence. We’ve seen them already,” sabi ni Luistro.

“They were enough to sustain probable cause, but as to whether they are enough to sustain conviction, it depends on the defense evidence which will be presented,” dagdag niya.

Gayunman, nagbabala si Luistro na kung muli umanong tatanggi ang kampo ni Duterte na maglahad ng ebidensya sa Senado, maaaring manatiling hindi napapabulaanan ang kaso ng prosekusyon.

“Pero kung hindi maglalatag ng ebidensya ang depensa, we can actually anticipate the appreciation of the senator-judges that the complainant’s evidence might be sufficient to support conviction,” aniya.

“Because it will remain unrebutted kung walang maglalatag ng ebidensya from the defense,” dagdag ni Luistro.
