ISANG Executive Order ang inilabas ni Pangulong Ferdinand R. Marcos Jr. para mabigyan ng real property tax incentive ang mga Independent Power Producers (IPP) na ang operasyon ay nasa ilalim ng Build-Operate-Transfer (BOT) scheme.

Ang EO 36 nagbabawas at nagbubura sa real property taxes (RPT) ng mga kuwalipikadong IPP na pinababayaran ng mga lokal na pamahalaan.

Ipinunto sa EO na ang RPT ay buwis na ipapasa lamang sa National Power Corporation/Power Sector Assets and Liabilities Management Corporation.

“While IPPs are taxable entities liable to pay the said RPTs, a substantial portion of the RPT has been contractually assumed by the National Power Corporation/Power Sector Assets and Liabilities Management Corporation under the Build-Operate-Transfer scheme and similar contracts, and therefore carry the full faith and credit of the National Government,” paliwanag sa EO.

Kung ipasasara umano ng mga lokal na pamahalaan ang mga planta ng kuryente dahil sa hindi pagbabayad ng RPT magreresulta ito sa pagmahal ng presyo ng kuryente at kakulangan sa suplay na magdudulot ng mga brownout hindi lamang sa kanilang lugar.

Iginiit sa EO na sa ilalim ng Section 277 ng Local Government Code of 1991, ang Pangulo ay maaaring magbawas o magbura ng RPT alang-alang sa interes ng publiko.
