NAWILI umano si Vice President Sara Duterte sa paggamit ng daang milyong pisong halaga ng confidential funds na nagsimula noong siya ay alkalde ng Davao City hanggang sa maupo sa Office of the Vice President.

Nabunyag ang naturang isyu sa pagdinig ng House Committee on Good Government and Public Accountability noong Miyerkoles na nag-iimbestiga sa maling paggamit ng Bise-Presidente sa pondo ng gobyerno partikular ang paggastos sa P500 milyong confidential fund mula 2022 hanggang 2023.

Sa pagdinig tinukoy ni Batangas 2nd District Rep. Gerville “Jinky Bitrics” Luistro ang pagkahilig umano ni Duterte sa confidential funds na nagsimula noong kanyang panahon bilang alkalde ng Davao.

“I wish to manifest my observation that the irregularities which have been observed in the utilization of confidential fund in the [OVP] should be checked as well. With respect to the utilization of confidential fund of Davao City during those times, the Mayor is no less than our Vice President,” ani Luistro.

Ang komite na pinamumunuan ni Manila 3rd District Rep. Joel Chua, ay iniimbestigahan ang umano’y alegasyon ng hindi tamang pamamahala ng bise presidente sa kaniyang pondo kasunod ng ulat ng Commission on Audit (COA).

Nagpalabas ang COA ng Notice of Disallowance para sa P73 milyon mula sa P125 milyong confidential funds na inilaan sa OVP, na ginastos sa loob ng 11 araw, mula Disyembre 20 hanggang 31, 2022 – o paggastos ng P11 milyon kada araw.

Pinuna rin ng COA ang P3 milyong confidential fund ng OVP noong 2023.

Binigyang linaw sa pagdinig ang pagkakaroon ng confidential fund ng mga lokal na pamahalaan salig sa Section 16 ng Local Government Code, na nagtatalaga ng responsibilidad sa mga LGU sa pagsusulong ng peace and order.

Ngunit giit ni Luistro, hindi naman kasama ang peace and order, surveillance o national security sa mandato ng OVP.

“Nowhere in the law or the Constitution does it say that the OVP is responsible for promoting peace and order, conducting surveillance activities, or handling matters of national security,” punto ni Luistro.

Sa kanyang interpelasyon ipinunto ni Luistro ang alokasyon ng confidential fund sa Davao City kumpara sa iba pang malalaking lungsod sa bansa kung saan noong 2022 na mayroong P460 milyon confidential fund.

Higit ito sa alokasyon sa mga highly urbanized cities gaya ng Cebu (P7.38 milyon), Manila (P120 milyon), Makati (P240 milyon), at Quezon (P75 milyon).

“Nakakapagtaka lang po kung bakit nalampasan pa ng Davao ang City of Manila, ang Makati, ang Quezon City. For Makati, Davao almost doubled the confidential fund. For City of Manila, it almost tripled the confidential fund. Ang Cebu City po was way left behind because it is only P7.38 million,” saad niya.

Idinetalye pa nito ang mga nakaraang confidential fund ng Davao na nagkakahalaga ng P144 milyon noong 2016, P294 milyon noong 2017, P420 milyon noong 2018, at P460 milyon kada taon mula 2019 hanggang 2022.

“I just wish to state for the record that while we acknowledge that the LGU is entitled to confidential fund, because under Section 16 of the Local Government Code, bahagi po ng mandato nila is the promotion of peace and order,” sabi ni Luistro

Dagdag niya: “I just wish to state for the record that during this time, 2018 to 2022, the Mayor of Davao City, I believe, is no less than the Vice President. And I wish to state for the record as well, that the confidential fund that we are discussing about the OVP, last quarter of 2022 and the first three quarters of 2023, the one in disposal, is no less than our Vice President as well.”

Pinuna rin ni Luistro ang proseso ng pagbili at liquidation ng confidential funds kumpara sa regular na pondo na aniya ay masyadong maluwag.

Ang limitado umanong dokumentasyon para sa confidential funds kabilang ang financial plan, accomplishment report, at sertipikasyon mula sa pinuno ng ahensya.

Kumpara ito sa regular na pondo na kailangan ng mas komprehensibong documentation tulad ng Memorandum of Agreement, kontrata, resibo at invoice.

Aniya, mas madali pang gastusin ang confidential funds na maaari gamitin sa supplies, renta ng safe house, at maging pagbili ng sasakyan para sa surveillance nang hindi dumadaan sa karaniwang procurement process gaya ng posting, bidding, at pagpili sa lowest bidder.

Ang patuloy aniyang paggamit ng OVP ng confidential fund at nagpapakita ng kawalan ng pangangasiwa at pagpipigil.

“The problem is that this leniency in the use of confidential funds is what leads to irregularities, prompting COA to issue notices of disallowance and prompting this Congress to conduct inquiries,” sabi niya

Dahil dito nanawagan si Luistro ng mas mahigpit na pagbabantay mula COA at iba pang ahensya sa procurement at liquidation ng confidential funds dahil sa maluwag at kakaunting rekisitos.

Nababahala ang mambabatas na ang kaluwagang ito ay maaaring magresulta sa maling paggamit at irregularidad gaya ng lumabas sa imbestigasyon sa paggamit ng OVP sa naturang pondo.
