NAIS lamang umano ng kampo ni Vice President Sara Duterte na pabagalin ang pag-usad ng impeachment trial sa paghahain nito ng petisyon sa Korte Suprema.

Bilang isang dating practicing lawyer, sinabi ni San Juan City Rep. Ysabel Maria Zamora, isa sa 11 na itinalagang taga-usig mula sa House of Representatives, na kilala ang taktikang ito sa kanilang propesyon.

“In any case, you will always have the other party, one or both parties, filing dilatory tactics. I had the privilege of appearing in court in many instances, and you will always have parties doing that, delaying the case,” ayon kay Zamora, anak ng dating House Minority Leader at San Juan Rep. Ronnie Zamora.

“Or if one doesn’t have a case, then they will file such petitions for certiorari (review) to go all the way up to the Supreme Court if only to prolong the process,” dagdag pa niya.

Naniniwala naman ang naturang mambabatas na makikita ng mga mahistrado ng Korte Suprema ang ganitong mga estratehiya.

Ayon kay Zamora, naniniwala siyang sa huli ay papabor ang mataas na hukuman sa kanila “to push through with this political exercise,” sa kabila ng pagsisikap ng kampo ni Duterte na hadlangan ang impeachment process sa pamamagitan ng paghiling ng temporary restraining order sa Senado at Kamara.

Kasabay nito, pinaalalahanan niya ang mga abogado ng depensa na isaalang-alang ang “landmark decision” ng Korte Suprema kaugnay sa impeachment proceedings, kung saan mahalaga ang doktrinang itinakda sa Francisco vs House sa kaso ng dating Ombudsman na si Merceditas Gutierrez.

Tinalakay sa isyung ito ang teknikalidad ng isang-taong pagbabawal sa pagsusumite ng mga reklamong impeachment.

“The reason why there’s a one-year ban is to protect both sides. First, if there are frivolous complaints against an official, then we don’t want more complaints to be dragging for a long time and preventing that official from doing his or her job,” paliwanag ni Zamora.

“Now, if there are pieces of evidence to show that that official committed serious crimes amounting to impeachable acts, then I guess we can present that within that one year, we can present that before the committee or before plenary,” dagdag niya.

Ayon sa kanya, ito ay magiging “enough to proceed to trial.”

Dagdag pa niya, “So, we don’t want it to be going on forever and hindering government officials from doing what they are supposed to do. That’s it,” binibigyang-diin ang karunungan ng Korte Suprema sa impeachment jurisprudence.
