SINABI ni Senador Panfilo “Ping” Lacson na maaari pa ring makilahok sa impeachment trial ni Vice President Sara Duterte ang mga senator-judges na nahaharap sa pag-aresto o pagkakakulong, ngunit sa pamamagitan lamang ng personal na pagdalo kung papayagan ng korte, at hindi sa online participation o pagboto.

Ayon kay Lacson, maaaring humingi ang Senate Impeachment Court ng “leave of court” sa Sandiganbayan o sa iba pang korte na hahawak sa mga kaso at, kung papayagan, maaaring utusan ang Bureau of Jail Management and Penology o iba pang custodians na samahan at dalhin ang mga senator-judges sa Senado.

“Work-from-jail is not allowed,” sabi ni Lacson sa isang panayam sa radyo.

“We cannot allow online participation because that is reserved for force majeure and national emergencies,” dagdag niya.

Sinabi ni Lacson na sa ganitong paraan ay makadadalo nang personal ang senator-judges habang nananatiling alinsunod sa Rules of the Senate ang proceedings.

“One remedy is for the Impeachment Court to ask the Sandiganbayan or any court/s to which their cases would be assigned for ‘leave of court,’ and if granted, order the Bureau of Jail Management and Penology or their custodian/s to escort them to the Senate so they may participate in the impeachment trial of the Vice President. The senator-judges will be physically present,” sabi niya.

Lumitaw ang usapin sa gitna ng patuloy na debate sa mga panukalang payagan ang online o remote participation at pagboto sa proceedings ng Senado.

Ayon kay Lacson, pinapayagan lamang ang remote participation sa mga kaso ng force majeure, matinding sitwasyon, o national emergency.

Sinabi niya na ang impeachment trial ay kinasasangkutan ng isang special tribunal na nililikha ng Senado sa ilalim ng Konstitusyon upang litisin at pagpasyahan ang impeachment cases.

“The impeachment trial involves a Senate-created special tribunal tasked under the Constitution to try and decide impeachment cases. Under the Constitution, the Senate must convene as an Impeachment Court to conduct the impeachment trial,” sabi ni Lacson.

Binanggit sa release ni Lacson ang kaso ni Senador Ronald “Bato” dela Rosa, na ayon dito ay nahaharap sa arrest warrant na inisyu ng International Criminal Court kaugnay ng anti-drug war ng administrasyong Duterte at hindi pisikal na dumadalo sa mga sesyon ng Senado.

Tinukoy din ng release ang iba pang senador na maaaring maharap sa legal proceedings kaugnay ng magkakahiwalay na alegasyon sa flood control projects, graft, plunder, indirect bribery, at campaign donations. Ang mga usaping ito ay kailangang beripikahin sa official court, Ombudsman, o prosecution records.

Nagbabala rin si Lacson na maaaring maging “double-edged sword” ang online participation para sa mga senador na posibleng umiiwas sa pag-aresto dahil maaari itong makatulong sa law enforcers na matunton ang kanilang lokasyon.

“If dela Rosa wants to participate and uses his mobile device or laptop, he inadvertently helps law enforcement in tracking him down,” sabi ni Lacson.

“If the law enforcers see his IP address, they have a good chance of getting him,” dagdag niya.
