IPINAGTANGGOL ni House Assistant Majority Leader at Lanao del Sur Rep. Zia Alonto Adiong ang planong pagsama kay Congresswoman-elect Leila de Lima sa House prosecution panel na siyang lilitis kay Vice President Sara Duterte sa nalalapit na Senate impeachment trial.

Ayon kay Adiong, wala itong nakikitang conflict of interest sa pagsali ni De Lima na marami umanong alam sa isyu ng extrajudicial killings (EJKs).

Sa panayam ng dzBB, sinabi ni Adiong na ang pagsama kay De Lima ay lehitimo, estratehiko at sumunod sa mga patakaran ng House of Representatives, bilang tugon sa mga batikos ng ilan kaugnay ng pagiging kritiko nito ni dating Pangulong Rodrigo R. Duterte, ang ama ng Bise Presidente.

“Wala naman siyang conflict dahil ang sinasabi naman sa rules, sa aming rules, ay kailangan miyembro ng House of Representatives. Si Congresswoman Leila De Lima naman ay magiging member ng House of Representatives sa 20th Congress,” paliwanag ni Adiong.

Itinuro rin ni Adiong na pinapayagan ng House ang pagkuha ng external legal experts upang makatulong sa pagbubuo ng matibay na kaso, na may precedent noong 2012 impeachment trial ng yumaong si dating Chief Justice Renato Corona.

“Allowed naman din na kumuha ang House of Representatives ng mga private lawyers. Makikita natin do’n during the time of Corona na merong nag-appear diyan as members of the prosecution na mga private practitioners na mga lawyers,” aniya.

Ayon sa mambabatas, ang track record at legal experience ni De Lima ang dahilan kung bakit siya ay kwalipikado upang tumulong sa pag-usig kay Duterte.

“We would not deny that. Isa sa mga Articles of Impeachment ay ‘yung EJK. And I guess the background of Congresswoman-elect De Lima, as far as the issue on EJK is concerned, expertise talaga niya ‘yan,” sabi ni Adiong.

Sinabi rin ni Adiong na pamilyar si De Lima sa mga kaso ng pagdukot at sa dami ng mga biktima ng EJK, at binanggit ang mga affidavit ng whistleblowers na sina Arturo Lascañas at Edgar Matobato bilang mahahalagang sanggunian.

Sina Lascañas at Matobato ay parehong umaming mga hit man na nagsabing kasapi sila ng tinatawag na Davao Death Squad, na umano’y pinamunuan ni dating Pangulong Duterte at iniuugnay sa EJKs ng daan-daang drug suspects at iba pang hinihinalang kriminal sa Davao City.

“I think ‘yung affidavit ni Matobato at ni Lascañas would have to play a very important role in how Congresswoman-elect De Lima would present and approach her case should she finally join officially the prosecution team and perhaps take on the issue,” ani Adiong.

Inaakusahan si Vice President Duterte sa Article 5 ng impeachment complaint ng high crimes, kasama ang murder at conspiracy to commit murder.

Suportado ang artikulong ito ng testimonial evidence mula kay Lascañas na nagsabing noong panahon ni Duterte bilang alkalde ng Davao City, siya mismo ang nag-utos ng mga pagpatay sa ilalim ng “Operation Tokhang,” at ang mga taong inilibing umano sa Laud quarry.

Naniniwala ang impeachment prosecutors na ang presensya ng direktang testimonial evidence ay malaking dagdag sa bigat ng kaso laban sa Bise Presidente at naniniwala silang ang artikulong ito pa lang ay sapat na upang makamit ang conviction.

Sinabi ni Adiong na layunin ng Kamara na bumuo ng isang malakas na prosecution team, anuman ang nakaraang political alignments ng mga magiging miyembro nito.

“So ‘yung sinasabi nilang for background niyang when she was known to be during her time in the Senate, known to be her archrival of the former president, would have to be taken at the back seat,” ani Adiong, ukol kay De Lima.

“Kasi the primary consideration is how to primarily form a very solid prosecution team, how they can argue well in terms of how the presentation of the evidence. Number three is how can Congresswoman-elect De Lima help out in the approach of the prosecution team as a group,” dagdag pa niya.

Aminado si Adiong na hindi maiiwasan ang mga puna, ngunit iginiit na ang desisyon na isama si De Lima sa prosecution panel ay nakabatay sa kwalipikasyon at batas.

“‘Yung mga ganoong klaseng statements and remarks and comments, of course hindi mo ‘yan matatanggal sa isipan ng tao because of the background ng bawat isa,” ani Adiong.

“But it doesn’t necessarily also make her, exempt her from ever becoming one as member of the prosecution team simply because of her politics or her stand when it comes to the issue of EJK or the war on drugs in the previous administration,” dagdag niya.

“So ang kanyang pagiging member ng prosecution team is primarily and essentially considered because she is and she would become a part of the House of Representatives in the next Congress,” muling giit ni Adiong.

Inaasahang pinal na babalangkasin ng Kamara ang 11-member prosecution team bago magbukas ang 20th Congress sa Hulyo, kung kailan magsisilbing impeachment court ang Senado.
