NAGHAIN ng mosyon ang House prosecution panel sa Senado na magsisilbing Impeachment Court upang pasagutin si Vice President Sara Zimmerman Duterte sa inihaing Articles of Impeachment laban sa kanya ng Kamara de Representantes.

Sa mosyon, hiniling ng mga taga-usig kay Senate President at Presiding Officer Francis Joseph G. Escudero na mag-isyu ng writ of summon kay Duterte at atasan ito na maghain ng kanyang sagot sa impeachment case sa loob ng 10 araw, mula sa araw kung kailan niya ito tinanggap.

Inihain sa Senado noong Marso 25 ang mosyon na pirmado ni House Minority Leader at 4Ps Party-list Rep. Marcelino “Nonoy” C. Libanan, isa sa 11-man prosecution team.

Nakasama ni Libanan sa paghahain sina 1Rider Party-list Rep. Rodge Gutierrez, kapwa miyembro ng prosecution panel; House Deputy Majority Leader Paolo Ortega V ng La Union; at House Assistant Majority Leader Jay Khonghun ng Zambales.

Si Libanan ay binigyan din ng otoridad na lumagda sa lahat ng pleadings para sa lahat ng public prosecutors ng Kamara.

“The Prosecution, represented by the members duly appointed by the House of Representatives, respectfully enters itself, and most respectfully moves that the Honorable Presiding Officer, Senate President Francis Joseph G. Escudero, issue Summons to respondent Vice President Sara Zimmerman Duterte (‘Duterte’) directing her to file her duly Answer to the Verified Complaint for Impeachment dated 5 February 2025 (‘Verified Impeachment Complaint’) duly endorsed and transmitted to the Honorable Impeachment Court,” ayon pa sa mosyon.

Si VP Duterte ay kasalukuyang nasa The Hague, Netherlands, matapos arestuhin ang kanyang ama na si dating Pangulong Rodrigo R. Duterte na nahaharap sa kasong crimes against humanity sa International Criminal Court.

Binigyang-diin ng mosyon na noong Pebrero 5 ay inihain ng Kamara sa Senado ang Articles of Impeachment na nilagdaan ng 215 kongresista, o lagpas sa requirement na 102 o one-third ng lahat ng kinatawan sa Mababang Kapulungan ng Kongreso.

Iginiit ng mga taga-usig na alinsunod sa Konstitusyon, dapat nang simulan ng Senado ang paglilitis sa sandaling matanggap ang nasabing reklamo.

“Pursuant to Section 3, paragraph 4, Article XI of the Constitution, the Verified Impeachment Complaint constitutes the Articles of Impeachment against respondent Duterte, and trial by the Senate, acting as the Impeachment Court, shall forthwith proceed,” saad pa dito.

Tinukoy nila mismo ang probisyon ng Konstitusyon na nagsasabing: “In case the verified complaint or resolution of impeachment is filed by at least one-third of all the Members of the House, the same shall constitute the Articles of Impeachment, and trial by the Senate shall forthwith proceed.”

Sa ilalim ng Rule VII ng Senate Rules of Procedure on Impeachment Trials, nakasaad: “A writ of summons shall be issued to the person impeached, reciting or incorporating said articles, and notifying him/her to appear before the Senate upon a day and at a place to be fixed by the Senate and named in such writ, and to file his/her Answer to said articles of impeachment within a non-extendible period of ten (10) days from receipt thereof.”

Dagdag pa rito, iginiit ng mga taga-usig na ang mga panuntunan ng Senado sa impeachment trials ay mananatiling epektibo hanggang sa ito ay baguhin o ipawalang-bisa alinsunod sa Rule XXV:

“These Rules shall take effect immediately upon publication in two (2) newspapers of general circulation and shall remain in force until amended or repealed.”

Dahil dito, nanawagan ang prosekusyon sa Senado na ipatupad ang mandato ng Konstitusyon at agad maglabas ng writ of summons kay VP Duterte upang umusad na ang pagdinig sa impeachment case.
