Sa Senate impeachment court 

NAGSUMITE ang House prosecution panel sa Senate impeachment court ng hinihingi nitong sertipikasyon na patunay na sumunod sa Konstitusyon ang ginawa nitong impeachment proceedings laban kay Vice President Sara Duterte.

Kasabay nito, nagsumite rin ang House prosecution panel ng isang manifestation sa impeachment court upang muling ihain ang kanilang entry of appearance nang walang anumang reserbasyon o kondisyon—taliwas sa mga dokumentong inihain ng kampo ni Duterte na tumangging kilalanin ang hurisdiksyon ng impeachment court.

Sa isang submission na may petsang Hunyo 25, kalakip ng House prosecution panel ang isang enrolled copy ng Resolution No. 328 (House Resolution No. 2346), na inaprubahan sa plenaryo noong Hunyo 11.

Ang resolusyong ito ay nagpapatibay na ang impeachment proceedings na sinimulan noong Pebrero 5 ay alinsunod sa Article XI, Section 3, Paragraph 5 ng 1987 Constitution, pati na rin sa House Rules of Procedure in Impeachment Proceedings.

“The House of Representatives, through the Public Prosecutors, most respectfully submits the attached enrolled copy of Resolution No. 328 (House Resolution No. 2346), adopted in Plenary on June 11, 2025, attesting to the fact that the impeachment proceedings initiated on February 5, 2025 against the Vice-President of the Republic of the Philippines, Sara Zimmerman Duterte, fully complied with Article XI, Section 3, Paragraph 5 of the 1987 Constitution and the Rules of Procedure in Impeachment Proceedings of the House of Representatives, including the circumstances on the filing of the first three (3) impeachment complaints,” ayon sa submission.

Binigyang-diin ng sertipikasyon na naipadala na ng Kamara ang Articles of Impeachment sa Senado alinsunod sa prosesong konstitusyonal.

“This submission is without waiver of the Prosecution’s position that there is no legal basis for the return of the Articles of Impeachment forwarded to the Senate in accordance with the 1987 Constitution, which enjoys a presumption of legality and constitutionality, consistent with the Resolution of the Honorable Court dated January 18, 2012, In the Matter of the Impeachment of Chief Justice Renato C. Corona, Case No. 002-2011 (Annex “B”) passing upon the same matters,” dagdag pa nito.

Samantala, sa isang manifestation na isinumite rin ngayong Miyerkules, binigyang-diin ng mga tagausig ng Kamara na ang muling pagsumite nila ng entry of appearance ay walang reserbasyon o kondisyon—taliwas sa ginawa ng legal team ni VP Duterte, na nagsumite ng Answer Ad Cautelam at isang qualified Entry of Appearance Ad Cautelam.

“The House of Representatives through the Public Prosecutors, unto this Honorable Impeachment Court, most respectfully re-submit their Entry of Appearance With Motion to Issue Summons dated 14 March 2025, previously filed by the prosecution on 25 March 2025, which remains in the record together with the Articles of Impeachment that remain lodged with the court,” ayon sa manifestation.

“In contrast to the Appearance Ad Cautelam dated 16 June 2025 filed by the counsels for the Respondent, Sara Zimmerman Duterte, there is no reservation, limitation or other qualification of any kind on the part of the undersigned public prosecutors,” dagdag pa nito.

Ang mga dokumento ni VP Duterte ay may markang ad cautelam, isang Latin na termino na nagpapahiwatig ng pag-iingat at patuloy na pagtutol sa hurisdiksyon o proseso.

Sa kabila nito, pinaigting ng mga tagausig mula sa Kamara ang kanilang paninindigan na dapat nang umusad ang paglilitis.

Sa kanilang malinaw na pagsuporta at walang kondisyong pakikilahok sa impeachment proceedings, pinagtibay nila ang kanilang paniniwala na kailangang gampanan na ng Senado ang tungkulin nito sa ilalim ng Konstitusyon upang litisin at pagdesisyunan ang kaso.

Nilagdaan ang submission ni Public Prosecutor Marcelino Libanan, na may awtorisasyon na kumatawan sa buong hanay ng mga tagausig mula sa Kamara.

Binigyan din ng kopya sina Bise Presidente Duterte at ang kanyang mga abogado mula sa Fortun Narvasa & Salazar.
