HUMINGI ng paglilinaw si senator-judge Panfilo “Ping” Lacson kay Impeachment Court Presiding Officer Francis “Chiz” Escudero kung ang 16-vote threshold para ma-convict si Vice President Sara Duterte ay legal opinion lamang o ruling na ng court.

Inihayag ni Lacson ang kanyang point of inquiry sa ikalawang araw ng impeachment trial nitong Martes, July 7, matapos sabihin ni Escudero na sa literal na pagbasa sa two-thirds requirement ng Constitution, kailangan ang boto ng hindi bababa sa 16 senator-judges para sa conviction.

“My point of inquiry, Mr. Presiding Officer, is, is this portion of your opening statement a matter of legal opinion on your part as presiding officer, or does it constitute a ruling by the impeachment court?” tanong ni Lacson.

Nakatuon ang isyu sa bilang ng boto na kailangan para ma-convict ang isang impeached official sa ilalim ng Constitution.

Dahil may 24 na puwesto sa Senado, nangangahulugan ang interpretasyon na kailangang makakuha ang prosecution ng hindi bababa sa 16 na boto para sa conviction.

Tinanong din ni Lacson kung maaari itong maging justiciable issue na maaaring dalhin sa Supreme Court kung kuwestiyunin ito ng prosecution o defense sa batayan ng grave abuse of discretion.

Sumagot si Escudero na ang kanyang posisyon sa 16-vote requirement ay ruling ng chair, at nananatili ito dahil walang senator-judge na tumutol o umapela sa impeachment court.

“So to clarify, yes, I believe it may be considered already as a justiciable controversy, although it is not for us to dictate that but the courts. Given that it is a ruling of the chair, not objected to nor appealed by any member of this court, and therefore stands,” sabi ni Escudero.

Dahil sa palitan, nailagay sa record ang posisyon ng impeachment court sa bilang ng boto na kailangan para ma-convict si Duterte.

Nahaharap si Duterte sa mga alegasyon sa impeachment case kaugnay ng confidential funds, unexplained wealth at alleged grave threats laban kay President Ferdinand Marcos Jr., First Lady Liza Araneta-Marcos at former Speaker Martin Romualdez, bukod sa iba pa.
