WALANG tuntunin na nagpapahintulot sa mga abogado ni Vice President Sara Z. Duterte na lumahok sa mga pagdinig sa impeachment sa House of Representatives, sinabi ni House committee on justice chair Gerville “Jinky Bitrics” R. Luistro ng Batangas, at nilinaw niya ang mahahalagang bahagi ng proseso bago simulan ang deliberasyon sa apat na reklamong inihain laban sa bise presidente.

“Wala po sa rules ang participation ng lawyers. It will only be the members of the Justice Committee who will participate in the deliberation,” ani Luistro sa isang ambush interview.

Dagdag niya, anumang hiling mula sa panig ng mga abogado ng bise presidente ay daraan pa rin sa pasya ng buong komite.

“But if in case there will be intention on the part of the lawyers of the vice president, this will be decided upon by the members,” saad ni Luistro.

Binigyang-diin din ni Luistro na iimbitahan si Duterte sa mga pagdinig, ngunit nilinaw niya na optional lamang ang pagdalo nito bilang bahagi ng due process.

“The Vice President will definitely be invited. Sabi ko nga sa inyo, that’s her right. That’s part of right to due process. But as to whether she will come or otherwise, it is actually her prerogative,” aniya.

“Kung dadating siya, it means that she is exercising her right to due process. Otherwise, that only means that she is waiving her right to be present during the hearing,” saad pa ni Luistro.

Nang tanungin kung makasasama ba sa bise presidente kung hindi ito sisipot, tugon ni Luistro: “If she doesn’t come, that only means that she is waiving her right.”

Tungkol naman sa kahilingan ng ikaapat na impeachment complaint na ipa-subpoena ang bank records ni Duterte at ng kanyang immediate family, tumanggi si Luistro na magbigay ng opinyon.

“I do not want to preempt the discussion about the possibility of getting these bank records. We have to determine first whether this impeachment will pass the sufficiency in form and substance,” aniya.

Ayon pa kay Luistro, walang anumang susunod na hakbang ang maaaring gawin kung hindi pumasa ang mga reklamo sa mga unang rekisito.

“Dito muna tayo sa initial stages ng proceeding ng Justice Committee and that is the determination of form and substance. Because if they do not pass in the standard of form and substance, no further proceeding will happen in the Justice Committee,” pahayag ni Luistro.

Sa harap ng mga puna na dapat inuuna ng Kongreso ang ibang isyu imbes na impeachment, sinabi niyang kayang gampanan ng Kamara de Representantes ang maraming tungkulin nang sabay-sabay.

“That is why I just finished. I just concluded my hearing on creation of court sala and on petition for naturalization,” aniya.

“Yes, we understand that. We are very much aware. Not just the Justice Committee but the rest of the committees and the rest of the members of the House have other matters to do bukod dito sa impeachment. And that’s why we really need to work hard for us to be able to address all our duty here in the House of Representatives,” sinabi pa ni Luistro.

Inulit ni Luistro na susunod ang komite sa tamang proseso — simula sa pagsusuri ng sufficiency in form at sufficiency in substance, bago tumuloy sa iba pang yugto.

“As I have said in the past interviews, kung anong procedure, kung anong parameter ang ginamit natin sa impeachment against the president, we will be adopting the same with respect to our impeachment process against the vice president,” ani Luistro.

Sa ngayon, aniya, ang pokus ng komite ay nananatiling procedural, at pagsunod sa mga alituntunin ng Kamara at Konstitusyon.

Ang ikaapat na impeachment complaint laban kay Duterte ay nakabatay sa mga alegasyong hindi umano niya lubos na idineklara ang ilang ari-arian sa kanyang mga Statement of Assets, Liabilities and Net Worth (SALN) at maaaring nagkaroon siya ng hindi maipaliwanag na yaman na lampas sa kanyang legal na kita.

Ang verified complaint ay inihain ni Atty. Nathaniel G. Cabrera at inendorso nina House committee on human rights chair Bienvenido “Benny” Abante Jr. ng Manila at Deputy Speaker Francisco Paolo Ortega V.

Inakusahan si Duterte sa reklamo ng mabigat na paglabag sa Konstitusyon, betrayal of public trust, graft and corruption, bribery at iba pang mabibigat na krimen.

Sa sentro ng reklamo ang mga alegasyong may mga ari-arian, bank account, cash holdings at property transactions na umano’y hindi nailagay, hindi lubos na nailahad o kulang ang detalye sa kanyang SALN.
