PASADO na sa Kamara de Representantes ang panukala na mag-aamyenda sa batas kaugnay ng pagbibigay ng legal assistance sa mga Pilipino sa ibang bansa.

Ang House Bill (HB) No. 9035, isang panukala na magpapalawig sa paggamit ng Legal Assistance Fund (LAF) at ng Agarang Kalinga at Saklolo Para sa mga OFWs na Nangangailangan (AKSYON) Fund na pamamahalaan ng Department of Foreign Affairs (DFA) at Department of Migrant Workers (DMW) ay nakatanggap ng 246 boto sa sesyon nitong Miyerkoles.

“Our overseas Filipinos are our modern-day heroes. Their immeasurable contributions to our country, their families, and communities merit the utmost protection from the government. This measure aims to do just that: protect them at all stages of the legal proceedings, from investigation to trial proper and even after,” sabi ni Speaker Ferdinand Martin G. Romualdez, lider ng higit 300 kongresista.

Sa ilalim ng HB 9035, nililinaw ang hurisdiksyon ng DFA at DMW sa paggamit ng mga ito ng kanilang legal aid funds kung saan ang DFA ang hahawak para sa overseas Filipinos at ang DMW naman para sa mga OFW.

Pangunahing may akda ng HB 9035 sina Reps. Teodorico Haresco Jr., Ron Salo, Eddie Villanueva, Jocelyn Tulfo, Noel Rivera, Salvador Pleyto, Ma. Alana Santos, Danny Domingo, Marissa Del Mar Magsino, Rosemarie Panotes, Irene Saulog, Kristine Tutor, Ciriaco Gato Jr., Edward Hagedorn, Wilter Palma, Keith Micah Tan, Linabelle Ruth Villarica, Sandro Gonzalez, LRay Villafuerte, at Mannix Dalipe.

Aamyendahan nito ang Section 26 ng Republic Act (RA) No. 8042, o ang “Migrant Workers and Overseas Filipinos Act of 1995,” para maisama sa sakop ng LAF ang mula sa pagiging legal aid para maging “consular assistance” na rin para sa mga overseas Filipino

“The expenditures to be charged against the Legal Assistance Fund shall include the fees for the foreign lawyers to be hired to represent overseas Filipinos facing charges, expenses for the filing of labor and/or criminal cases against erring or abusive employers or other persons abroad, bail bonds to secure the temporary releases and other litigation expenses,” saad sa panukala.

“Provided, that the Legal Assistance Fund shall, at all times, be made available from the time of the investigation, detention, arrest or indictment of the overseas Filipinos all the way to the trial proper, and at all levels of appeal thereafter,” dagdag pa rito.

Sa mga bansa na wala pang tanggapan ng DMW, ang DFA ang binibigyan ng mandato na palawigin ang legal at iba pang uri ng tulong sa mga OFW sa naturang mga lugar.

Para naman sa AKSYON Fund, inaamyendahan ng panukala ang Section 14 of RA 11641, o “Department of Migrant Workers Act,” par palawakin ang gamit ng AKSYON Fund para sa OFWs.

Gaya ng sa LAF ang AKSYON Fund ay ginagamit rin mula sa imbestigasyon, detention, pagkaka aresto o indictment ng OFW pati na sa paglilitis at lahat ng apela sa hinaharap.

Kung kinakailangan, ay gagawing exempted sa RA 9184 o Government Procurement Act ang pagkuha ng foreign legal cousnel at paglalabas ng pondo para sa iba pang pangangailangan na nakasaad sa probisyon ng panukala.
