POSIBLE umanong mayroong nalabag ang Sonshine Media Network International (SMNI) sa pag-ere nito ng “fake news” na gumastos si Speaker Ferdinand Martin G. Romualdez ng P1.8 bilyon sa mga biyahe nito.

Ito ang sinabi ng National Telecommunications Commission (NTC) at Kapisanan ng mga Brodkaster ng Pilipinas (KBP) sa naging pagdinig ng House Committee on Legislative Franchises kung saan sinabi ng mga opisyal ng Kamara de Representantes na P4.3 milyon lamang ang ginastos ni Romualdez mula Enero hanggang Oktubre 2023.

Nagsagawa ng pagdinig ang House committee on legislative franchises  matapos isapubliko ng host ng SMNI na si Jeffrey “Ka Eric” Celiz sa programang “Laban Kasama Ang Bayan” ang maling impormasyon kaugnay sa umano’y P1.8 bilyong gastos ni Speaker Romualdez sa biyahe.

Ayon kay Celiz nakatanggap ito ng mensahe mula sa dalawang source kaugnay ng nabanggit na travel expenses ng lider ng Kamara.

Inamin din nito na sinabi niya ang impormasyon ng walang nakikitang ebidensya.

Sa naturang pagdinig, sinabi naman ni House Secretary General Reginald Velasco na P4.3 milyon lamang ang gastos sa biyahe ni Romualdez. Ang buong Kamara ay gumastos naman ng P39.6 milyon.

Tinanong ng mga mambabatas si NTC Deputy Commissioner Alvin Blanco kaugnay nito.

“There appears to be infractions, Mr. Chair, on certain provisions of the franchise, particularly the reference provision on Section 4 on the responsibility of the franchisee not to use the station or its facilities for the dissemination of willful or false information,” sabi ni Bianco.

Ang tinutukoy ni Bianco ay ang probisyon ng Republic Act 11422, ang batas na nagbigay ng 25-taong prangkisa sa SMNI o Swara Sug Media Corporation of the Philippines. Naisabatas ito noong 2019.

Ang NTC, isang attached agency ng Department of Information and Communications Technology, ang nagsisilbing regulator ng telecommunication services sa bansa.

Kasama sa mandato nito ang pag-regulate at pangangasiwa sa mga istasyon ng radyo at telebisyon, cable at pay TV.

Sinabi naman ni KBP Vice President for Legal and Regulatory Compliance Group Rudolph Jularbal na maaaring mayroong paglabag na nagawa ang SMNI nang payagan nito ang isang hindi accredited brodkaster na umere.

Si Celiz at ang co-host nitong si Lorraine Badoy ay hindi accredited ng KBP.

Ayon kay Jularbal, ang SMNI ay accredited ng KBP kaya dapat itong sumunod sa kanilang mga panuntunan. Isa sa mga panuntunan ang pagtiyak na sumailaim sa mga lecture kaugnay ng code of ethics ang mga anchor at reporters, at pagkuha ng accreditation exam.

“Considering the information gathered during this hearing, your honors, I will report to the standards authority of KBP,” sabi ni Jularbal.

Nang tanungin kung ang SMNI ay nakasunod sa mga probisyon ng KBP Code of Conduct, sagot ni Jularbal: “Your Honor, we beg your indulgence, but in the context of what has been presented and of which I am informed this hearing, the network is lacking in observance of the Code of Conduct.”

Sinabi ni Jularbal na sa kasalukuyan ay nagsasagawa rin ng imbestigasyon ang KBP kaugnay ng mga reklamo laban sa SMNI, partikular sa pagpapakalat ng fake news at red-tagging.

Iginiit naman ni Parañaque City 2nd District Rep. Gus Tambunting, ang chairman ng House franchise panel, ang kahalagahan ng patas at totoong pagbabalita na nakasaad sa Broadcaster’s Code of the Philippines.

Sinabi ni Tambunting na bagamat ang malayang pagsasalita at pamamahayag ay karapatan sa ilalim ng Konstitusyon, ang frequency ng TV at radio network ay saklaw ng kapangyarihan ng Kongreso.

“Let me emphasize that the mandate of the Committee on the Legislative Franchises is the granting, amendment, extension, or revocation of legislative franchises,” punto ni Tambunting.

“It is authorized to exercise its oversight function to determine whether or not the franchise grantees faithfully comply with the terms and conditions of its franchise,” dagdag pa ng kongresista.

Humingi ng paumanhin si Celiz kay Romualdez at sa Kamara kaugnay ng nagawa nitong kasiraan samantalang sinabi naman ni Badoy na hindi ito sangkot sa smear campaign laban sa Kamara.

Muling magsasagawa ng pagdinig ang komite sa Disyembre 5.

Ang imbestigasyon ay nag-ugat sa privilege speech ni House Deputy Majority Leader at Quezon Rep. David Suarez na umamin na nasaktan sa ipinalabas na hindi berepikdong impormasyon sa programa ng SMNI.

Kasama rin sa tinatalakay ng komite ang resolusyon ng Makabayan bloc kaugnay ng pagpapakalat umano ng istasyon ng fake news at red-tagging.
