Dalipe: Pagtalaga sa sarili ni VP Sara bilang designated survivor wala sa Konstitusyon
BUKOD sa pagkakaroon ng pangamba, ikinagulat din umano ni House Majority Leader at Zamboanga City Rep. Manuel Jose “Mannix” M. Dalipe ang naging pahayag ni Vice President Sara Duterte na nagtatalaga sa kanyang sarili bilang “designated survivor.”
Sinabi ni Dalipe na maaaring magkaroon ito ng negatibong epekto kay VP Sara na isang abogado at miyembro ng Bar.
“To begin with, nowhere in our 1987 Constitution is it stated that the Vice President has the authority or power to appoint herself, or anyone else, for that matter. Furthermore, the term ‘Designated Survivor’ is not found in any of our statutes,” giit ni Dalipe.
“The authority to appoint is exclusively vested in our President, who makes appointments ranging from Cabinet members to directors of government agencies,” dagdag pa nito.
Sa isang ambush interview, natanong si VP Sara kung dadalo ito sa ikatlong State of the Nation Address (SONA) ni Pangulong Ferdinand R. Marcos Jr. sa Hulyo 22.
Sagot ng Ikalawang Pangulo: “No, I will not attend the SONA. I’m appointing myself as the Designated Survivor.”
Sa ilalim ng 1987 Constitution, sinabi ni Dalipe na nakasaad ang line of succession sa mga halal na opisyal ng bansa.
Ayon sa Section 8, Article 7 ng Konstitusyon, ang Bise Presidente ang papalit sa Pangulo kung ito ay mamamatay, magbibitiw, matatanggal o hindi na kayang gampanan ang kanyang tungkulin.
Pagsisilbihan nito ang nalalabing termino ng pinalitang pangulo.
Ang halimbawa umano nito ay ang nangyari noong 2001 nang palitan ni Vice President Gloria Macapagal Arroyo si Pangulong Joseph Estrada.
Kung hindi pwede ang Ikalawang Pangulo, ang hahalili ay ang Senate President at kung hindi rin maaari ay ang Speaker ng Kamara de Representantes, hanggang sa mahalal ang bagong Pangulo at Bise Presidente.
“The Vice President’s statement is deeply concerning because the term ‘Designated Survivor’ originates from a Korean and an American Netflix series about a government being completely wiped out in a terror attack orchestrated by those seeking to seize power,” dagdag pa ni Dalipe.
