ANG patuloy na pagtanggi ng Senado na mag-convene bilang impeachment court para litisin si Vice President Sara Duterte ay maaari umanong resulta ng selective interpretation ng Konstitusyon o isang political strategy.

Sa kanyang pagharap sa media nitong Lunes, iginiit ni Bataan Rep. Geraldine Roman, ang chairperson ng House committee on women and gender equality, na ang katagang “forthwith” na nakasaad sa probisyon ng impeachment sa Konstitusyon ay malinaw na ang ibig sabihin ay agad-agad.

Kinuwestyon niya kung bakit patuloy na inaantala ng liderato ng Senado ang paglilitis sa impeachment sa kabila ng malinaw na mandato ng batas.

“Katulad nga ng sinabi ko kahit anong diksyonaryong konsultahin ko, forthwith means immediately. And I think the choice of the word forthwith is basically what they normally do when they write the Constitution, the fundamental law of the land, use normally literary and highfaluting words. So maybe it was a selective interpretation,” wika ni Roman.

Dagdag niya na ang pagkaantala ay maaaring isang estratehiyang politikal, partikular na ng mga senador na tumatakbo muli sa eleksyon dahil naging isang malaking isyung pangeleksyon na ang impeachment case.

“Ito lang naman ako, maybe it was his political strategy. Kasi nga if we go on with impeachment case at this point, baka ‘yung mga tumatakbong senador ay maapektuhan. Because fact of the matter is that impeachment case has become an election issue. And I don’t know, politician din naman ako, I would understand,” sabi niya.

Nananatili namang positibo si Roman na si Senate President Francis “Chiz” Escudero at ang liderato ng Senado ay ikokonsidera ang kanilang posisyon at aaksyon salig sa Konstitusyon.

“But then again, who would admit that, that I have this gut feeling. But nevertheless, I still hold on to my hope that our friends in the Senate led by SP Chiz Escudero would reconsider and be more, I don’t know how should I say it, mas magampanan nila ang kanilang trabaho na igalang, i-uphold ang what is stated clearly in the Constitution,” dagdag niya.

Sinegundahan ito ni Deputy Majority Leader Paolo Ortega V ng La Union at sinabi na ang desisyon kung kailan magsisimulan ang impeachment trial ay nakaatang sa liderato ng Senado.

“Ako ano, this has been my consistent statement from the start. Sabi ko nga, number one, it’s a leadership call, number one. Pero ‘yung sa tipong pangalanan, isa-isahin, matatanda na po sila, alam na nila ‘yon. Ang pangalawa po, leadership call is also a call to action. So kung may call to action ka, you have a responsibility at may responsibility po tayo sa taong-bayan. ‘Yan lang po ‘yung comment ko doon,” sabi ni Ortega.

Sinangayunan ito ni Roman at binigyang-diin na ang direksyon ng paglilitis sa impeachment ay tinutukoy ng liderato ng Senado kaysa ng indibidwal na senador.

“So hindi lang pala ako ang may nararamdaman na something in that line, no, it’s related to politics and being strategic about it and not wanting this issue to become an electoral issue that could actually tilt the balance against my political interest. But I also agree with Cong. Paolo that it is a leadership call,” saad niya.

Ang pinakalohikal aniyang direksyon na sundin dapat ng Senado ay ang mandato ng Konstitusyon na naglalatag ng proseso at timeline ng impeachment trial.

“More than just the individual senators, I think it should be the Senate leadership who should set the line of direction, ‘di ba, where they’re headed. And as I said, I think the only acceptable direction is the direction of the Constitution which is very clear about when and how this impeachment complaint should be processed,” aniya.

Nang matanong kung naniniwala ba siyang nilabag ni Escudero ang Konstitusyon dahil sa pagaantala ng impeachment trial, umiwas nang magbigay ng pahayag si Roman bagama’t nababahala sa pamamaraan ng pagahawak ng Senado sa proseso.

“At this point it would be difficult to say kung meron talagang intentional or I don’t know, violation. Parang harsh naman kaagad to come at that judgment, no. Our dear friend Sen. Chiz Escudero is a brilliant lawyer and he does his own studying. We may differ in our opinions, but still, ‘yun na nga, umaasa pa rin kami from the HOR for maybe a different interpretation,” sabi pa niya.

Bagama’t naglabas na aniya ng special order ang Senado na naglalatag ng petsa para sa paglilitis ng impeachment, mas nanaisin pa rin ng Kamara na masimulan ito ng mas maaga.

“Anyway, they came up with this special order, nakasaad na nga ‘yung calendar nila. Sa aming panlasa, sana nga mas maaga. Pero katulad nga ng sinabi ko baka may practical considerations that come into place. Ako lang naman ito. Baka personal opinion, ‘yung aking intuition. But I’m not saying it’s true. I can’t read people’s minds basically,” wika niya.

Sa kabila ng pagkaantala, nananatiling optimistiko si Roman na pakikinggan ng Senado ang panawagan para sa mabilis at patas na pagtalakay sa impeachment.

“Mawala nang lahat, huwag lang nang pakiramdam. Pero nandiyan pa rin ang pag-asa. Mawala na rin lahat, huwag lang ang pag-asa na pakikinggan nila ang aming suhestyon,” saad niya.
