IBINASURA ng Office of the Ombudsman ang mosyon na humihiling na suspendihin si Speaker Ferdinand Martin G. Romualdez at ilan pang opisyal ng Kamara de Representantes kaugnay ng umano’y iregularidad sa pagpasa ng 2025 General Appropriations Act (GAA).

Sa 10-pahinang resolusyon, ipinahayag ni Ombudsman Samuel Martires na walang merito ang mosyon para suspendihin si Speaker Romualdez at iba pang opisyal ng Kamara, at binigyang-diin na ang Konstitusyon ang nagkakaloob sa Kongreso ng eksklusibong kapangyarihan upang disiplinahin ang kanilang mga miyembro.

“Unquestionably, the Office of the Ombudsman possesses full disciplinary authority over public officials and employees, except impeachable officials, members of Congress, and the Judiciary.

Since respondents are members of the House of Representatives, this Office does not have the authority to order their suspension,” pahayag ng Ombudsman.

Nilagdaan ni Martires ang resolusyon noong Marso 7, 2025, ngunit inilabas lamang ito sa publiko noong Marso 11.

Sa naturang desisyon, tuluyang ibinasura ang mosyon na inihain noong Pebrero 19 nina Davao del Norte Rep. Pantaleon Alvarez, abogadong si Ferdinand Topacio, Citizen’s Crime Watch president Diego Magpantay at retiradong B/Gen. Virgilio Garcia, na humihiling ng preventive suspension kay Speaker Romualdez at sa kanyang mga kapwa respondent.

Kasama sa mga nagreklamo si senatorial candidate Jimmy Bondoc, na inakusahan si Romualdez at tatlong iba pang opisyal ng Kamara ng pagpeke ng mga dokumentong pambatas at paglabag sa Anti-Graft and Corrupt Practices Act o Republic Act (RA) 3019 sa umano’y P241 bilyong halaga ng mga insertions sa 2025 budget bill.

Kabilang sa mga pinangalanang respondent, bukod kay Romualdez, sina Reps. Manuel Dalipe ng Zamboanga City, Elizaldy Co ng Ako Bicol Party-list, Stella Quimbo mg Marikina City at mga hindi pa nakikilalang miyembro ng Technical Working Group ng Bicameral Conference Committee.

Nilinaw na ni Quimbo, na may mahalagang papel sa deliberasyon ng budget, na ang mga blangkong bahagi sa reklamo ay inilaan para sa mga technical staff upang gumawa ng kinakailangang pagsasaayos at walang diskresyon ang mga mambabatas na baguhin ang mga halaga sa yugtong iyon.

Ipinag-utos ni Martires na pansamantalang ihinto ang pagtalakay sa reklamo, binanggit ang nakabinbing petisyon sa Korte Suprema na inihain nina Davao City Rep. Isidro Ungab, abogadong si Victor Rodriguez at iba pa, na kumukuwestiyon sa konstitusyonalidad ng 2025 GAA o RA 12116.

“After a careful reading of the complaint, I am convinced that the issues raised herein are closely intertwined, if not, intimately related to a Petition for Certiorari and Prohibition that was earlier filed before the Supreme Court,” pahayag ng Ombudsman.

Ipinaliwanag niya na kapag may kasabay na espesyal na aksyong sibil at kasong kriminal, kailangang hintayin ng quasi-judicial body ang desisyon ng Korte Suprema bago ipagpatuloy ang anumang imbestigasyon.

“The Supreme Court must first resolve the issue of constitutionality before the criminal action pending before the Ombudsman will proceed. Whatsoever will be the resolution of the Supreme Court in the Petition for Certiorari and Prohibition would be determinative juris et de jure of the guilt or innocence of herein respondents in the criminal case before the Ombudsman,” paliwanag ni Martires.

Dagdag pa niya, kung paninindigan ng Korte Suprema ang pagiging balido ng 2025 budget law, mawawalan ng probable cause para sa anumang kasong kriminal. Ngunit kung ito ay ideklarang labag sa konstitusyon, saka lamang maaaring kumilos ang Ombudsman sa reklamo.

“Indeed, there is a prejudicial question that necessitates suspension of the criminal proceedings until such time that the Special Civil Action has been resolved with finality by the Supreme Court,” saad pa ng Ombudsman.
