MAGPAPATULOY lamang ang paglilitis ng Senado laban kay Pangalawang Pangulo Sara Duterte kapag natanggap na nila ang pormal na sertipikasyon at awtorisasyon mula sa Ika-20 Kongreso, ayon kay Atty. Regie Tongol, tagapagsalita ng Impeachment Court, sa isang press conference nitong Hulyo 2.

Ayon kay Tongol, “6 out of the 11 major steps outlined in the procedural framework or that accounts for 55% of the entire process has already been accomplished by the impeachment court.”

Kabilang sa mga hakbang na ito ang panunumpa ng mga senador bilang mga huwes. Gayunpaman, nakabinbin pa rin ang susunod na yugto, na nakaasa sa magiging aksyon ng Mababang Kapulungan.

Nilinaw ni Tongol na ang sertipikasyong hinihintay mula sa Kamara ay hindi hadlang, kundi isang hakbang upang matiyak ang legalidad ng proseso: “to help prevent any legal impediment or challenges or technicalities that could undermine the impeachment process once it starts rolling and to uphold the proceedings’ integrity.”

May ilang nagtatanong kung sapat na ba ang eleksyon ng mga tagausig mula sa Kamara bilang senyales ng pagsisimula. Subalit iginiit ni Tongol na, “Congress is a collegial body and it can only act collegially through its parliamentary procedures such as passing of a resolution or a bill.” Dagdag pa niya, “authority must be memorialized… like for example in a corporation… the board of directors has to come up with a board resolution.”

Tinukoy rin niya na, “the authority rin ng House prosecutors ng 19th Congress has already ended when the 19th Congress adjourned. So there needs to be another authorization from the 20th Congress of the new set of House prosecutors.”

Ipinaliwanag ni Tongol na ang maingat na galaw ng Senado ay bunsod ng pagnanais na iwasan ang anumang legal na suliranin: “Kaya kung makikita niyo ang galaw ng Senate President or presiding officer mula Pebrero, napakaingat kasi nga lagi niya sinasabi dito since February ayaw niya ng legal hurdles na maiakit pa sa Supreme Court.”

Tinanong kung posible bang muling magtipon ang impeachment court bago ang Hulyo 29, tugon ni Tongol: “hindi sila pwede mag-convene kung wala pong communication from the House kung sino ang House prosecutors. Kasi gusto nila magkaroon ng appearances doon ang House prosecutors at yung defense.”

Bagama’t kinikilala ang impeachment court bilang isang “continuing body,” sinabi ni Tongol na, “Kung medyo may pagdududa ba kayo kung continuing body ba o hindi, the position taken is it is actually a continuing body… However, may pangapong mga question kung sino ba yung presiding officer ngayon?”

Hangga’t walang pormal na komunikasyon mula sa Kamara at hindi pa nakapagtatalaga ng bagong Senate President ang Ika-20 Kongreso, mananatiling nakabinbin ang mga pagdinig. Ani Tongol, “We would rather err on the side of safety rather than on the side of questions and doubts.”
