HINDI umano ang resulta ng mga survey kundi ang Konstitusyon ang batayan ng impeachment trial ni Vice President Sara Duterte, ayon kay Batangas 2nd District Rep. Gerville “Jinky Bitrics” Luistro.

“Well, I have said this earlier, regardless of the result of the survey, we have a constitutional duty that we really have to face. There is nothing which is more supreme than the Philippine Constitution. Sapagkat ito ang mandato ng taong-bayan,” sabi ni Luistro sa mga mamamahayag sa isang ambush interview nitong Miyerkoles.

“So regardless of the results of the survey, mataas man ang porsiyento ng sumusuporta sa impeachment or mababa man ang porsiyento ng sumusuporta sa impeachment, this is mandatory for us to conduct a trial,” dagdag pa niya.

Ang pahayag ni Luistro ay kaugnay ng pinakahuling survey ng Social Weather Stations (SWS) na 59 porsiyento ng mga Pilipinong tinanong ang pamilyar sa reklamong impeachment laban kay Duterte.

Sa mga sumagot, 42 porsiyento ang hindi sang-ayon sa reklamo, 32 porsiyento ang sang-ayon, at 18 porsiyento ang undecided. Ang natitirang 7 porsiyento ay nagsabing wala silang sapat na kaalaman upang magbigay ng opinyon.

Lumabas din sa parehong survey, na isinagawa noong Hunyo 25 hanggang 29, na 44 porsiyento ng mga sumagot ang naniniwalang sinasadya ng Senado, bilang impeachment court, na iantala ang paglilitis.

Dalawampu’t limang porsiyento ang hindi naniniwala rito, 22 porsiyento ang undecided, at 9 porsiyento ang nagsabing wala silang sapat na kaalaman upang sumagot.

Tinawag ni Duterte ang reklamong impeachment bilang isang uri ng political persecution at harassment. Ayon sa kanya, naghahanda ang kanyang legal team ng matibay na argumento upang hilingin ang pagbabasura ng kaso.

Hindi sumang-ayon si Luistro sa pahayag ni Duterte at iginiit na dapat basehan ng proseso ang lakas ng ebidensiya, hindi ang pulitikal na retorika.

“Kung walang ebidensiya, that is political prosecution. Pero kung may ebidensiya, that is a legitimate prosecution. As far as we are concerned, we have ample and strong evidence supporting the seven Articles of Impeachment,” aniya.

Tinalakay rin ni Luistro ang mga pangamba na maaaring makaapekto sa damdamin ng publiko ang mga pahayag ng ilang senador na magiging hukom sa impeachment.

“Somehow, yes, but we have to understand also hindi lang mga senator judges ang nagsasalita. A lot of deans of colleges of law have spoken. A lot of legal experts have spoken. And even the chairperson of the 1987 Constitutional Commission has spoken. We need to proceed to trial right away because that is the mandate of our Constitution,” ani Luistro. \

Tinukoy rin niya na ang pananaw na walang basehan ang reklamo ay maaring dulot ng patuloy na suporta ng publiko sa pamilya Duterte.

“We have to consider also na the Duterte family still has significant number of supporters and that is why there is a need really for us to proceed to the presentation of evidence so that the people will have an ample opportunity to assess really if we have a basis to proceed to this prayed for. That is, of course, the removal and the perpetual disqualification,” paliwanag niya.

Nang tanungin kung nababahala ba siya na maaaring lumakas pa ang opinyon ng publiko dahil sa mga pahayag ng pulitiko, sinabi ni Luistro na ginagawa lamang ng prosecution panel ang kanilang tungkulin batay sa batas.

“That is one of the possibilities, but we have to consider really kung ano ba talaga ang iminamandato sa atin ng Constitution. The people are entitled to see the evidence of the prosecution,” sabi niya.

“At the end of the day, sabi ko naman, after we are done with the presentation of the evidence, they can either vote to convict or to acquit. So I believe there’s nothing to lose if they will allow the prosecution to proceed with the presentation of evidence,” dagdag niya.

Nagpahayag din ng kahalintulad na pananaw ang ilang miyembro ng Kamara, na nagsabing dapat payagan ng Senado na ituloy ang paglilitis upang makabuo ng sariling opinyon ang publiko.

Ayon kay Zambales 1st District Rep. Jay Khonghun, ang malaking bilang ng mga undecided na respondent ay nagpapakitang naghihintay pa ang maraming Pilipino na makita ang aktwal na ebidensiya.

“Marami pa ring undecided. Talagang inaantay pa rin, gusto nilang mapanood ‘yung magkaroon ng impeachment trial. So hindi natin pwedeng panghawakan ang survey na ‘yan kasi napakadami pa rin talagang undecided na gustong mapanood at gustong makita kung ano talaga ang nilalaman na ebidensiya na ipepresenta ng prosecution,” ani Khonghun.

Para naman kay Lanao del Sur 1st District Rep. Zia Alonto Adiong, nakakapagtaka kung bakit minamadali ang pagbabasura ng reklamo kahit na pabor sa kanila ang resulta ng survey.

“If they are so confident about the survey, then why are they still pushing for the dismissal of the impeachment case? Eh sabi nga nila that the people’s leaning is towards to their advantage. Why are they afraid to have the impeachment trial to proceed? Eh kung kampante naman sila doon sa survey nila, ba’t nila idi-dismiss?” sabi ni Adiong.

“So I guess that’s kind of conflicting altogether, living in the survey and yet pushing for the dismissal of the case,” dagdag niya.
