HINDI sang-ayon si Manila 3rd District Rep. Joel R. Chua sa naging pagsuporta ng Integrated Bar of the Philippines (IBP) sa naging desisyon ng Korte Suprema na nagdedeklara na unconstitutional ang inihaing impeachment case laban kay Vice President Sara Duterte.

“Respectfully, I dissent with the Integrated Bar of the Philippines on its statement on the Supreme Court decision on Duterte v. House of Representatives,” ayon kay Chua sa isang pahayag.

“I dissent because the Constitution is above Congress, the Executive, and the Judiciary. The Supreme Court, being the ‘court of last resort,’ cannot supplant, expand, or add to the Constitution.

Their latest decision on impeachment did supplant, expand, and add to what the Constitution so clearly provides,” dagdag pa niya.

Si Chua, miyembro ng House prosecution panel, ang kasalukuyang namumuno sa House committee on good government and public accountability, na kilala rin bilang House Blue Ribbon Committee.

Siya rin ang pinuno ng naturang komite noong nakaraang Kongreso na nag-imbestiga sa umano’y maling paggamit ng P612.5 milyon sa confidential funds, kasama ng iba pang mga iregularidad, ng Office of the Vice President at ng Department of Education (DepEd) sa ilalim ng pamumuno ni Vice President Duterte.

Ang mga natuklasan mula sa mga pagdinig ay naging batayan ng inihaing impeachment laban sa Pangalawang Pangulo.

Taliwas sa mga alegasyon ng procedural impropriety, iginiit ni Chua na kumilos ang Kamara ayon sa eksklusibong kapangyarihang itinakda ng Konstitusyon sa pagsusulong ng Articles of Impeachment.

“I understand where the IBP is coming from. In fact, I empathize. But we in the House have the exclusive power to advance Articles of Impeachment exactly as the Constitution provides. We did not act in disregard of due process,” aniya.

“We acted according to the last legal resort available to the Filipino people when the highest and impeachable public officials violate the public trust,” pagtatapos ni Chua.
