IISANG pamantayan ang inilapat ng House committee on justice sa mga reklamong impeachment laban kina Pangulong Ferdinand “Bongbong” R. Marcos Jr. at Vice President Sara Z. Duterte, ngunit ang mahalagang kaibahan, ayon sa chair ng komite, ay ang mga alegasyon laban kay Duterte ay sinusuportahan ng ebidensiya ng direktang partisipasyon.

Tinuligsa ni Batangas Rep. Gerville “Jinky Bitrics” Luistro, chair ng House committee on justice, ang pahayag ng Pangalawang Pangulo na gumamit umano ang Kamara de Representantes ng dobleng pamantayan, at iginiit na naging consistent ang panel mula pa sa simula.

“Of course, there is a very big disparity between the impeachment against the President and the Vice President. ’Yung kay Presidente, hindi mo makita ang personal participation. As a matter of fact, no evidence that will establish ’yung naging participation ng Presidente in the corruption,” sinabi ni Luistro sa programang Laban Para sa Karapatan sa radyo nina Atty. Lorna Kapunan at Jaime Regalario sa dwIZ noong weekend.

“Because the corruption happened not in the approval of the budget, it happened in the implementation. So nasaan ang Presidente doon sa implementation? Of course, you cannot question his having approved the General Appropriations Act (GAA) kasi kapangyarihan niya ’yon,” ani Luistro.

“Since day one, ang naging pronouncement namin and even in all our actions, we applied exactly the same parameter. Kung anong pamantayan ang ginamit namin sa Presidente, gano’n din ang pamantayan na ginagamit namin sa Bise Presidente. And even with respect to the entire procedure, parehas na parehas,” dagdag ni Luistro.

Ayon kay Luistro, sinuri ng panel kung may personal na pagkakasangkot sa mga gawaing inilahad sa reklamo laban sa Pangulo, ngunit hindi ito nakakita ng sapat na batayan upang patunayan iyon.

Ani Luistro: “The only difference is with respect to the personal participation na ito ang paulit-ulit kong narinig sa mga justice members. Doon sa impeachment process ng Presidente may allegation diyan ng corruption. May allegation diyan ng, ano ito, dito sa mga pagpasa or pag-approve ng GAA, the unprogrammed appropriation. Pero ang hinahanap talaga ng mga justice members is the personal involvement. The personal participation what evidence do they have to establish the personal participation?”

Sinabi niya na ang mismong paglagda sa GAA ay hindi maaaring ituring, sa sarili nito, bilang patunay ng katiwalian, sapagkat ang sinasabing maling gawain sa reklamo ay hindi umano naganap sa panahon ng pag-apruba ng badyet.

“Granting na pinirmahan ng Presidente, the GAA, which includes even the unprogrammed appropriation. Hindi naman doon nangyari iyong corruption, di ba? It’s just a process, a ministerial process in passing the budget legislation which is the General Appropriations Act. So nasaan? ’Yong mismong ebidensiya that will show the personal participation of the President in the alleged corruption. Hindi sapat na pumirma siya ng GAA 2025 because that’s part of his duty,” saad ni Luistro.

Pinatingkad pa niya ang pagkakaibang ito sa pagsasabing ang katiwalian umano sa kaso ng Pangulo ay may kaugnayan sa implementasyon, hindi sa pag-apruba, at nabigo ang reklamo na punan ang puwang na iyon.

Pahayag ni Luistro: “Siya iyong nag-a-approve ng mga legislation, appropriation legislation towards coming up with this General Appropriations Act. So bagaman ang naging participation lang niya is ang pagpirma, hindi natin ’yan puwedeng i-allege na proof of corruption because indeed the corruption did not happen in the approval of the GAA. It happened during the implementation.

So kung pinuntahan naman natin ang implementation, nasan doon ang participation ng Presidente?”

Tungkol naman sa Pangalawang Pangulo, sinabi ni Luistro na ibang-iba ang nakikitang larawan ng panel, na nagsisimula sa pampublikong video kung saan narinig si Duterte na nagbanta laban kay Pangulong Marcos, sa Unang Ginang at sa dating Speaker.

“Siguro magandang illustration diyan ’yung threat. Threat or having contracted an assassin to assassinate the President, the First Lady and the former Speaker. Ibalik natin ’yung issue ng personal participation. May personal participation ba ang Vice President doon sa allegation of having contracted an assassin as the whole world was able to watch that video?” ani Luistro.

Para kay Luistro, ang partikular na alegasyong iyon ay hindi na nangangailangan ng masalimuot na hanay ng mga paghihinuha.

“Ito ’yung sinasabi ng justice members, res ipsa loquitur. Everything is in the video already. It was the Vice President who is actually uttering the words of threat against these three important personalities and having shared to the whole world na nakontrata siya ng assassin who will do the killing against these three personalities if she dies,” saad niya.

Ang banta ni Duterte noong Nobyembre 2024 laban sa Pangulo, Unang Ginang Liza Araneta-Marcos at noo’y Speaker Ferdinand Martin G. Romualdez ay naging usapin ng pambansang seguridad at malawakan itong naiulat noong panahong iyon.

“If we will be talking about the personal participation, hindi pa ba sapat ’yung video na ’yan? It was she herself who was uttering those words in the video which was seen by the whole world,” sinabi ni Luistro.

Pagkatapos nito’y muling binalikan ni Luistro ang paghahambing na ngayon ay nasa sentro ng depensa ni Duterte.
