IGINIIT muli ni Senate President Vicente Sotto III nitong Sabado na walang senador ang maaaring arestuhin sa loob ng gusali ng Senado bilang bahagi ng institutional dignity at courtesy, sa gitna ng mga ulat na naglabas ng warrant of arrest ang International Criminal Court (ICC) laban kay Sen. Ronald Dela Rosa.

“I am not privy to the warrant being issued. But as I have said in the past and in consultation with some members of the Senate, to preserve the dignity of the Senate, and as a matter of institutional courtesy, we cannot allow any senator to be arrested in the Senate premises. Outside the Senate premises, that’s no longer our concern,” ani Sotto sa isang Viber message sa mga mamamahayag.

Nauna nang ibinunyag ni Ombudsman Jesus Crispin Remulla sa isang panayam sa radyo na may “good authority” ito upang kumpirmahin ang paglabas ng ICC warrant laban kay Dela Rosa kaugnay ng kampanya kontra droga ng administrasyong Duterte.

Sa kanyang mga Facebook post, namahagi si Dela Rosa ng tulong sa mga biktima ng Bagyong Tino sa Cebu noong Huwebes at Biyernes sa ilalim ng “Operation Tabang,” na pinondohan aniya ng kanyang mga tagasuporta mula Davao, Cagayan de Oro at Bukidnon.

Si Dela Rosa, na nagsilbing hepe ng Philippine National Police sa ilalim ng dating Pangulong Rodrigo Duterte, ay pangunahing tagapagpatupad ng giyera kontra ilegal na droga.

Si Duterte, 80, ay nakakulong sa ICC sa The Hague, Netherlands, mula noong Marso 13. Nahaharap siya sa tatlong bilang ng crimes against humanity kaugnay ng mga pagpatay sa kampanya kontra droga, bilang alkalde ng Davao City at bilang pangulo ng Pilipinas.

Sa isang pahayag nitong Sabado mula sa kanyang legal counsel na si Israelito Torreon, nanawagan ang kampo ni Dela Rosa sa publiko at media na mag-ingat habang wala pang opisyal na kumpirmasyon mula sa mga awtoridad o ICC mismo.

“We have been made aware of circulating reports claiming that the International Criminal Court has issued an arrest warrant against Senator Ronald ‘Bato’ Dela Rosa,” ani Torreon.

“At this point, we do not have independent confirmation as to whether or not this information is accurate. We therefore urge the public and the media to exercise caution and restraint in sharing or interpreting such reports until verified information is officially released by competent authorities or by the ICC itself,” dagdag niya.

Kung mapatunayang totoo, sinabi ni Torreon na umaasa silang “the Philippine government will act in accordance with the rule of law, and that any such action shall first pass through the proper local judicial confirmation process consistent with our constitution, due process, and the sovereign rights of the Republic of the Philippines. For now, we shall await official confirmation before making any further statement on the matter.”

Cayetano: Panatilihin ang due process

Samantala, nanawagan si Senate Minority Leader Alan Peter Cayetano sa mga institusyon ng pamahalaan na manatiling nakabatay sa prinsipyo at rule of law.

Kanyang binigyang-diin na ang Rules on Extradition Proceedings ng Korte Suprema ay nagbibigay ng balangkas na nagpoprotekta sa hustisya at due process.

“The Court has drawn the line clearly: extradition and all acts of justice must be rooted in law and due process, not in bias or emotion. Opinions change, but principles remain. That is how we preserve justice and protect democracy,” ani Cayetano sa hiwalay na pahayag.

Tiniyak niya sa publiko na “no one is above the law, and no one is beneath its protection,” at binigyang-diin na ginagarantiya ng konstitusyon ang pantay na pagtrato sa lahat ng mamamayan anuman ang posisyon.

“I call on the Senate leadership to uphold this principle by protecting both the institution and the integrity of our laws. Let us show that the Senate stands not for privilege, but for fairness ― that we will uphold for our members only what we are willing to uphold for every Filipino: justice without bias, and equality before the law,” aniya.

Binigyang-diin ni Cayetano na ang batas ay dapat magsilbi para sa katotohanan at pagkakaisa, hindi para sa pulitika o pagkakahati, at ang tiwala sa pamahalaan ay lalago lamang kapag ang hustisya ay naipapatupad “faithfully and without fear or favor.” Philippine News Agency
